Settling a child's personal injury claim: consent and BEM. General information. When settling a minor's claim, representation and possible subdistrict-court permission matter. Consequences may last for years. Before agreeing, establish who must consent and what authorisation is required in this case. Ask which medical information and future expectations support the proposal. School, care and later opportunities may be uncertain. Discuss reasonable assumptions and possible specific reservations. Closing a file does not remove uncertainty. A Dutch BEM account is a blocked bank account in the name of a child under eighteen. The legal representative needs subdistrict-court permission for withdrawals. The block ends automatically when the child turns eighteen. Ask which documents the account requires and how necessary expenses are requested. Authority to settle does not automatically permit every later withdrawal. Keep the judicial decision, agreement and bank records together. Check losses, previous advances, costs and the balance due. Have the final wording assessed and record who monitors future issues. Our guide prepares parents; it cannot replace assessment of the child's interests and circumstances. Read the full explanation and sources on our website.
