Settling a minor child’s injury claim: approval and protection
Human legal and translation review is still pending.
A child’s claim can involve questions that become clear only later: education, development, assistance and future work. Particular safeguards also govern representation, settlement and managing money. This guide organises these subjects for parents and others. It does not determine an adequate agreement or replace specialist advice and the competent court’s assessment.
In this guide
Whose claim is it and who may act?
First make clear which losses belonging to the child are being investigated and who is legally authorised to act. Practical contact with a school or insurer does not itself create every legal power. Questions about parental responsibility, guardianship or different parents require the correct route to be established. Ask your adviser what information and consent are needed for investigation, instructions and a possible final settlement.
Keep parents’ own costs and possible entitlements separate. A parent may have paid for travel while also communicating for the child. These are different roles. A person-by-person category overview prevents unclear recipients and releases. Preserve decisions and authorisations with the scope of each power recorded.
Consider development and education too
Consequences may appear when a child meets new tasks and expectations. Identify school, independence, support and activity questions. Let medical and other experts establish current knowledge and what requires later assessment. A child has no complete career yet; that justifies neither inventing a whole future nor ignoring it.
Keep pre- and post-event functioning manageable and calm. School arrangements and existing assistance provide context. Developmental changes are not automatically accident-caused. Record observations and investigate connection carefully. Ask what evidence genuinely matters and avoid continually requiring the child to perform or confirm symptoms for the claim.
Read offers for positions and assumptions
Ask which categories and periods the figure includes. Have past costs, help, immaterial effects and future uncertainty been separately discussed? An unexplained total does not show what is bought out. Show advances and reimbursements explicitly. A large round figure is not automatically sufficient for this child’s described consequences.
Ask which records support the proposal and which assumptions remain uncertain. Buying out a risk now differs from a specific reservation. Request understandable explanations of future effects. Parents need not become experts to ask why duration, development or support needs have been selected in calculations.
Discuss court approval early
The Council explains that settlements for minor victims generally need kantonrechter permission. Establish beforehand which authorisation and documents your situation requires. Agreement between parents and insurer does not automatically replace judicial safeguards. Ask who prepares requests and what action cannot yet become definitive.
The application should explain injury, effects and proposal clearly. Have the child’s role and required involvement assessed appropriately. A general age rule from a short page is not complete signing guidance. Responsible advisers must check representation, agreement type and current process for the actual case.
What does a BEM clause do?
Court information explains that accounts with BEM clauses protect minors’ funds by restricting withdrawals without approval during minority. Ask the bank and adviser what documents are required for correct opening. Ordinary savings in the child’s name are not automatically the same arrangement.
Keep permission, account details and deposit information together. Check ownership and settlement references. Proper administrative execution is part of protection. If a different payment route is proposed, ask how it aligns with necessary arrangements. Do not rely solely on reassurance that the money is ultimately intended for the child.
Withdrawals and spending need their own route
According to court guidance, withdrawal under a BEM clause before adulthood needs the appropriate judge’s approval. Necessary treatment or another expense supports a focused application, not bypassing protection. Identify amount, specific purpose and records supporting necessity.
An advance during ongoing claim handling may concern a different phase. Ask how immediate necessary expenses and protected capital are distinguished. Costs for the child should be assessed carefully while remaining assets stay protected. The expense tool gives no withdrawal permission and cannot determine what courts accept.
- Describe the withdrawal amount and specific expense for the child.
- Keep a quotation or other evidence and check who may legally apply.
- Seek withdrawal permission separately; do not treat earlier settlement approval as automatic withdrawal authorisation.
Do not silently omit tax and family finances
Court information notes possible tax and financial consequences of funds on a BEM account. Have actual effects examined where required. Blocking access does not automatically remove every financial consequence. This guide provides neither general tax exemption nor guarantees concerning means-tested arrangements.
Ask who investigates and what agreements are necessary. A lawyer seeking permission and a bank opening accounts do not automatically answer every tax question. Assign work clearly. Preserve advice and decisions so the assessed situation, conditions and necessary actions remain traceable later.
Clarify implementation and future follow-up
After possible approval, ask who checks final documents, when payment follows and how implementation is verified. Keep the agreement, court decision, calculations and proof. A reservation needs identifiable risk and notification requirements. Record monitoring and contacts; retaining a folder alone is not complete follow-up.
Involve the child appropriately for age and circumstances without assigning responsibility for adults’ legal choices. As independence grows, understandable explanation of the file and money helps. Tools offer discussion points, not confirmation of adequate settlement or completed permission. A careful process distinguishes rights, decisions, payment and administration.
| Subject | Question to check |
|---|---|
| Representation | Who may act for the child, and for what? |
| Offer | Which losses and future uncertainties were assessed? |
| Authorisation | What approval is needed and who applies? |
| Payment and management | Do account, protection and payment match? |
| Follow-up | Who monitors reservations and deadlines? |
Frequently asked questions
Can parents simply close the child’s case?
Check representation and required authorisation first. Minor settlements have safeguards. An insurer agreement does not automatically replace required judicial assessment.
Is a BEM account an ordinary children’s savings account?
No. The clause protects and restricts withdrawal before adulthood. Ask the bank for documents and check alignment between account and agreement with advice.
May I withdraw money for necessary expenses?
The required permission applies to BEM withdrawals before adulthood. Discuss a specific request with amount, purpose and support. Medical necessity does not automatically permit bypassing account conditions.
Why is everything not settled immediately?
Future development and consequences may remain uncertain. That need not stall every case but requires informed assessment of evidence, assumptions and reservations. Explain rights the child may surrender through final agreement.
