Medical error: complaint or damages claim?. General information.
Treatment can disappoint without a medical error. A damages claim requires examination of the care and its link to additional harm. Ask what happened and distinguish consequences of the original condition from possible extra consequences.
Make a timeline and gather relevant medical records. Ask which decisions were taken and what risks were discussed beforehand. Information and consent may matter. Another operation or difficult recovery alone does not establish liability.
For explanations or dissatisfaction, approach the care provider and an independent complaints officer. Disciplinary proceedings pursue a different purpose from a civil damages claim. Ask what each route can achieve and which conditions fit your situation.
A recognised healthcare disputes body can issue a binding decision. Rijksoverheid explains that a court will not then reconsider the complaint fully on its merits. Before filing, ask what this means for your claim and alternatives.
Continue discussing necessary treatment with your clinician during the investigation. Ask who monitors legal deadlines and what medical assessment is needed. Our guide prepares the first conversation; it does not determine whether your provider is liable.
Read the full explanation and sources on our website. Obtain an assessment of which rules apply to your situation.
