Personal injury limitation periods: no single deadline. General information.
Personal injury cases do not share one deadline. The period depends on the claim, the party involved and previous events. Record the accident date, but also who might have to pay and why.
Het Juridisch Loket describes a usual five-year period for unlawful-act claims, starting when the damage and responsible person are known. This is no universal safe calculation. Other routes and special cases, including minors, may follow different rules.
A limitation period can be interrupted under conditions. Wording, the correct recipient and proof of effective action matter. Merely asking about progress does not necessarily preserve your rights.
Do not assume waiting for an insurer suspends every deadline. Preserve letters and delivery records. Ask a new handler explicitly who takes over deadline monitoring and when action is required; retain that confirmation.
If a period may be expiring or already expired, seek a concrete legal assessment immediately and provide all correspondence. Do not conclude yourself that everything is lost or safely preserved. Our guide helps collect the necessary information.
