Employer bankrupt after a workplace accident: where do you report your injury claim?

Editorial draft. Independent legal and native-language reviews remain pending.

A bankrupt employer calls for a focused next step: verify the trustee, submit the injury claim with evidence and separately investigate existing insurance. A UWV wage arrangement does not automatically take over your whole injury claim. This guide helps an employee under Dutch law keep routes separate; acceptance, priority and actual payment are not established by it.

In this guide
  1. Check which employer has been declared bankrupt
  2. Submit your injury claim to the trustee
  3. Identify known and uncertain losses
  4. Investigate existing insurance separately
  5. Separate UWV wage payments and injury compensation
  6. Reassess existing proceedings or collection
  7. Assess other parties on their own legal basis
  8. Plan follow-up of evidence, responses and costs

Check which employer has been declared bankrupt

A message that the business is closing is not a bankruptcy judgment. Check the employer's full name, legal form and known registration details. Several businesses may use a trading name. Record the judgment date and insolvency number once known. This avoids sending documents only to a former manager or similarly named new business and assuming the claim is properly registered.

Rechtspraak explains that the Central Insolvency Register contains insolvency information and the current trustee; available digital reports may provide further detail. Use it to verify contact and case, not predict a distribution percentage. An unsuccessful search does not always prove there never was a bankruptcy. Check criteria and currency and clarify which case concerns your legal employer if uncertain. Rechtspraak — toelichting Centraal Insolventieregister ↗

Submit your injury claim to the trustee

According to Rechtspraak, creditors submit claims and evidence to the trustee (curator). Ask which submission method and details the office requires. Include accident, employer, liability basis being investigated, known loss and earlier correspondence. The liability notification guide helps organise foundational documents. A prior letter to employer or insurer is not automatically registration in the bankruptcy case. Rechtspraak — faillissement, gevolgen voor schuldeisers ↗

Request confirmation of receipt and registration reference. Distinguish receipt, substantive assessment and admission: acknowledgement does not establish liability, amount or priority. Rechtspraak describes verification and payment under a distribution list if payment becomes possible. Obtain assessment of your injury claim's treatment. This guide awards no ranking and predicts no money available for the claim. Rechtspraak — faillissement, gevolgen voor schuldeisers ↗

Identify known and uncertain losses

Medical recovery may continue while a trustee asks for an amount and documents. Prepare a dated schedule of known expenditure, payments and consequences under investigation. Explain uncertainty rather than inventing a final figure. Ask lawyer and trustee how to lodge and update a claim not yet finally quantifiable. A general “all losses to follow” does not without assessment replace every necessary record.

For each update identify what is new: invoice, changed capacity or additional income information. Refer to the earlier submission and ask whether the supplement was added to the same case. Keep versions and receipt evidence. The injury evidence guide helps preparation. Do not indiscriminately send your complete medical file to a general email address: establish who needs information and the secure channel.

Investigate existing insurance separately

Employer bankruptcy differs from insurer bankruptcy and does not prove a policy never existed. Gather lawfully available insurance details, accident and notification dates, policy references and cover responses. Request missing information from the trustee; obtain professional assessment of applicable policy and possible payment route. The uninsured employer guide explains responsibility, cover and payment.

Ondernemersplein emphasises that terms determine insurance cover. Bankruptcy does not itself decide which loss an insurer must pay or who must perform a particular step. Have notification, applicable period, qualifications and entitlement to any claim assessed separately. Trustee admission does not establish an insurer's cover decision. Do not assume a new policy pays simply because a business continues under the same name. Ondernemersplein/KVK — bedrijfsaansprakelijkheidsverzekering ↗

Separate UWV wage payments and injury compensation

UWV describes takeover of certain wages and conditions for other employment-related amounts under insolvency. Treat this as a separate route with its own assessment. Keep wages, UWV receipts and injury items separately recorded. An invitation or application does not establish that the whole occupational injury claim, including future consequences, has been accepted or taken over. UWV — uitbetaling uitkering wegens betalingsonmacht ↗

Ask UWV which submitted items are assessed and discuss what separately belongs with trustee or possible insurer. Keep decisions and payment specifications and their periods. This avoids unexplained duplication or missing a balance. Wages may inform an income-loss calculation, but correct treatment needs assessment. This guide offers no new benefit guarantee or full UWV application instructions.

Unpaid wages and their possible payment by UWV are governed by separate rules when your employer becomes bankrupt.

Reassess existing proceedings or collection

Were proceedings, instalments or collection already underway at bankruptcy? Immediately send judgment and trustee details to your lawyer or bailiff. Ask how bankruptcy affects that specific step and what action is needed. Do not assume an existing letter or judgment permits individual attachment as though bankruptcy had not occurred.

Rechtspraak states that creditors cannot individually attach assets in bankruptcy and submit their claim to the trustee. Earlier judgments or payment records remain important evidence, but do not automatically create priority or immediate distribution. For an existing case, have procedural position and insurance route assessed separately. Ask about costs of stopping, continuing or changing instructions. Assess other parties on their own legal basis

Several businesses may be involved in occupational injury, such as an agency and hirer. One business failing does not automatically make another liable. Record employer, person assigning work and workplace. Any other party needs separate legal grounds and evidential assessment, rather than sending everyone the same unexplained claim. Rechtspraak — bedrijfsongeval of beroepsziekte ↗

The same applies to directors, shareholders and new owners. A bankrupt company does not automatically make them personally pay your loss. A restart with the same name does not itself establish obligations transferred. Provide concrete documents and clarify the legal relationship. The work injury guide gives the general assessment; this bankruptcy guide creates no automatic alternative recovery basis.

Plan follow-up of evidence, responses and costs

Agree who contacts the trustee, investigates insurance and monitors necessary deadlines. Keep an action log of documents, responses and next discussion. Clarify whether an unclear message concerns liability, amount, cover or bankruptcy treatment. Do not indefinitely await one future report while other necessary steps may arise.

Budget legal help in phases and ask your own exposure if recovery fails. The legal costs guide prepares funding questions. Trustee involvement, insurance investigation or success in a dispute does not guarantee full costs. Keep recovery, financial urgency and case in view. Seek assessment before settlement or waiver: a small available amount does not inherently justify finally closing uncertain future injury loss.

  • Verify entity, judgment, insolvency reference and trustee.
  • Submit the injury claim with key documents and request registration confirmation.
  • Identify future uncertainty and agree updates and deadline monitoring.
  • Investigate existing insurance and UWV wages as separate routes.
  • Discuss existing cases, costs and arrangements before proceeding.

Frequently asked questions

Is liability notification already submission to the trustee?

Do not assume so. Verify receipt and registration in the right case. Retain the earlier letter as evidence and ask what else is needed.

Must I wait until fully recovered?

Do not delay bankruptcy steps without advice. Record known and uncertain loss separately and clarify how a provisional claim is lodged and updated.

Does UWV take over my entire injury claim?

Do not infer that from a wage arrangement or application. UWV assesses its own insolvency items. Discuss separately which amounts concern UWV, trustee or insurer.

Does an insurer always pay after employer bankruptcy?

No. Investigate applicable policy, claim, conditions and required steps. Bankruptcy alone proves neither cover nor entitlement.
