A medical reservation in a settlement: make the agreement workable
Editorial draft. Independent legal and native-language reviews remain pending.
You want to conclude the claim, but a particular medical development remains uncertain. A reservation may sometimes leave that defined risk outside final settlement. The word reservation alone does not explain when another entitlement arises, what must be established or who acts later. This guide helps prepare the agreement under Dutch law and keep it accessible after closure, without promising a standard clause for every case.

Identify the risk that cannot yet be responsibly closed
Ask which medical development or future costs remain uncertain and how the offer treats them. Has the risk already been reflected in the amount, or is a particular event excluded? Not every uncertainty requires a separate reservation. De Letselschade Raad notes that favourable and adverse possibilities may already form part of compensation. A general wish to leave everything open does not produce a clear agreement.
The settlement guide concerns closing the whole claim. This article focuses on making one defined exception workable. Separate the risk, its medical basis and financial consequences. A treating clinician can explain health issues; the legal wording and effect of the reservation need distinct assessment. Administrative speed is no reason to omit that step before agreeing.
Establish the basis of the later comparison
A reservation may refer to an existing medical position, a report or a defined development. Check title, author, date, version and attachments of that baseline. Ask exactly what forms part of the agreement. A reference merely to the medical report can create later uncertainty if several documents exist or the draft differs from the final version.
Keep the complete document with the accepted agreement. The table connects baseline, triggering development and consequence. Do not casually delete older versions; mark the version legally used. The evidence tool can organise locations but drafts no valid clause. The purpose is to preserve a verifiable record of the position the parties actually adopted as their baseline.
| Element | Record beforehand | Later purpose |
|---|---|---|
| Baseline | Exact report, version and condition | Verifiable comparison |
| Trigger | Defined development and conditions | Assess whether the reservation applies |
| Implementation | Consequences, notification and responsibility | Focused further claim and deadline review |
Understand the triggering development
Ask what must happen before the reservation can be invoked. Does it concern a defined change, treatment or additional consequence, and how is its connection with the original event assessed? Do not use medical labels yourself to bring every later difficulty within the agreement. Have the conditions and uncertainty already covered by final compensation explained.
An exception for one consequence does not automatically reopen every loss. Ask which financial effects it covers and how overlap with paid compensation is avoided. The future loss guide helps discuss assumptions. Broad-sounding language may contain restrictive conditions; a narrow agreement may reflect a deliberate choice. Understand that choice before acceptance in a language you sufficiently understand.
Discuss evidence without guaranteeing a future outcome
The case described in the advocate general’s 2016 opinion involved an old reservation and a partly missing baseline report. Other expert evidence mattered to the comparison in that particular case. That is no reason to discard your records or assume a lost file can always be reconstructed. Keep what may be needed to establish the trigger and comparison.
Ask what medical evidence would support a later development and how an expert is selected if the parties disagree. The medical assessment guide explains roles. A reservation does not automatically make a later diagnosis accident-related or establish the amount. A further claim may still require investigation of conditions, connection and specific additional loss.
Notification, recipient and information form part of implementation
Discuss who receives a later notification, which contact details are retained and what happens if an insurer or organisation changes. Ask whether the agreement imposes notification or other conditions. An administratively closed file is different from a workable future action plan. Record where to obtain legal help and who assesses notification if the specified development occurs.
Share medical information purposefully with an appropriate recipient. A general service inbox does not automatically need the entire record. Keep notification, attachments and receipt evidence with the agreement. Do not assume a telephone call replaces every required action. When circumstances change, promptly investigate what step is necessary rather than waiting until all costs are final.
A reservation still needs separate deadline assessment
The words indefinite duration do not by themselves establish that no time limit can ever run. The applicable regime and interpretation of the agreement matter. The limitation guide explains why parties and entitlements need separate assessment. Do not import a universal limitation period from one old case into every medical reservation. The particular contractual conditions can affect the analysis.
Before closure, identify who monitors deadlines, when review takes place and what changes you must report. Record this even if the firm closes its administrative handling. Your own reminder can reveal missing confirmation but cannot replace legal assessment. Seeking treatment for new symptoms and protecting rights are different actions which may need to proceed together.
Read the reservation alongside final discharge
Check that the exception genuinely fits the description of what is settled permanently. Ask if a broad discharge and reservation appear inconsistent. Also check persons, events and losses identified. You cannot necessarily dispose of another person’s rights. A reservation concerning your own injury does not automatically deal with every entitlement held by someone else.
For a child, additional safeguards apply; the minor settlement guide provides context. Have representation and necessary court approval checked separately. A reservation does not replace other validity requirements. Tax issues or a tax guarantee may likewise require distinct terms and advice. One clause does not automatically resolve every future issue in final settlement.
Create a preservation package before closure
Keep the signed or otherwise finally agreed version, baseline report, relevant attachments, financial breakdown and written explanation together. Add contact details, responsibilities and review arrangements. Use secure, durable storage you can find later. A message saying you can always call is no substitute for a clearly agreed legal exception.
Ask whether wording or attachments changed after earlier advice. Oral or digital acceptance may already matter, so do not automatically wait for a signature before requesting explanation. The settlement tool organises points but settles nothing and creates no valid reservation. The agreement should clearly state what is final and what may be reassessed under which conditions.
- Identify the specific risk and what is already compensated.
- Identify and preserve the complete baseline report.
- Understand trigger, consequences and relation to discharge.
- Agree notification, recipient, costs and deadline responsibility.
- Keep the final agreement with attachments and review arrangements.
Frequently asked questions
Does a medical reservation leave the whole future open?
Not automatically. Wording, risk, conditions and already compensated losses matter. Understand what is final and which exception is actually agreed.
Can I discard the baseline report after closure?
Keep it with the agreement. It may be needed to assess later change. A case where other evidence helped does not guarantee replacement of every missing report.
Does indefinite duration remove all deadlines?
Do not assume so. Contract interpretation and the particular entitlement need assessment. Explicitly agree monitoring and action when circumstances change.
Is the clause sufficient for a child’s settlement?
No. Address special representation and required approval separately. A future reservation does not replace the remaining safeguards for a minor.
